Frequently asked questions

A property auction legal pack is a comprehensive collection of documents that provides potential buyers with all the necessary legal and property details before bidding. It helps ensure that buyers have a complete picture of the property’s title, condition, and any potential issues.

While contents can vary depending on the property and seller, most legal packs will include:

  • Title Documents:
    • Title Register: Confirms ownership and outlines any restrictions or rights affecting the property.
    • Title Plan: Provides a map detailing the property’s boundaries.
  • Contract for Sale:
    • Outlines the terms, conditions, and any special obligations involved in the sale.
  • Seller’s Property Information:
    • A detailed statement covering the history, structure, and known issues of the property.
  • Searches and Enquiries:
    • Local Authority Searches: Information on planning permissions, building regulations, and local issues.
    • Drainage and Water Searches: Details about the property’s connection to public utilities and drainage systems.
    • Environmental Searches: Assessment of potential environmental risks such as contamination or flooding.
    • Chancel Repair Liability Search: Details on any obligations towards local church repairs.
  • Leasehold Information (if applicable):
    • Documents covering lease terms, ground rent, service charges, and restrictions imposed by the landlord.
  • Planning and Building Control Documents:
    • Copies of planning permissions and building regulation approvals for any past works or extensions.
  • Additional Documentation:
    • Information on easements, restrictive covenants, fixtures and fittings, and any warranties or guarantees.

A legal review is essential to:

  • Ensure Compliance: Confirm that all documents meet legal requirements and that there are no hidden risks.
  • Identify Issues: Flag any potential legal or financial issues, such as title defects, restrictive covenants, or planning irregularities.
  • Provide Peace of Mind: Help you make an informed decision about bidding by providing clarity on the property’s legal standing.
